《案例1》某建筑工程采用邀請招標方式。業主在招標文件中要求: (1)項目在21個月內完成, (2)采用固定總價合同, (3)無調價條款。承包商投標報價364000美元,工期24個月。在投標書中承包商使用保留條款,要求取消固定價格條款,采用浮動價格。但業主在未同承包商談判的情況下發出中標函,同時指出:(1) 經審核發現投標書中有計算錯誤,共多算了7730美元。業主要求在合同總價中減去這個差額,將報價改為356270(即364000-7730)美元。(2) 同意24個月工期。(3) 堅持采用固定價格。承包商答復為: (1)如業主堅持固定價格條款,則承包商在原報價的基礎上再增加75000美元。 (2)既然為固定總價合同,則總價優先,計算錯誤7730美元不應從總價中減去。則合同總價應為439000(即364000+75000)美元。在工程中由于工程變更,使合同工程量又增加了70863美元。工程最終在24個月內完成。最終結算,業主堅持按照改正后的總價356270美元并加上的工程量增加的部分結算,即最終合同總價為427133美元。而承包商堅持總結算價款為509863(即364000+75000+70863)美元。最終經中間人調解,業主接受承包商的要求。案例分析: (1)對承包商保留條款,業主可以在招標文件,或合同條件中規
